Terms of Service

Welcome to Lots! These Terms of Service govern your use of our logistics services for shipments from South Africa to Botswana. By using our services, you agree to these terms.


1. Service Overview

Lots provides a logistics service for collecting purchases from a designated pickup point in South Africa and delivering them to customers in Botswana. Our services include:


  • Collection from pickup points
  • Customs clearance
  • Delivery to customer’s specified address in Botswana
  • Shopping assistance (when requested)


Lots does not operate as a retailer, reseller, or customs authority. We act solely as a logistics service and are not responsible for the accuracy of the items packed by your supplier.


2. Customer Responsibilities

Customers must:


  • Provide accurate shipping details and contact information.
  • Ensure that all orders comply with Botswana import regulations.
  • Pay all applicable service fees, including duties and import taxes.
  • Inspect items upon delivery and report any courier-related issues within 24 hours.


3. Payment & Fees


  • All charges, including delivery fees, customs duties, and import taxes, must be paid in full before orders are delivered.
  • No refunds are issued for service fees once delivery has been completed.
  • Additional charges may apply for:
  • Returns
  • Failed collection fees (if return conditions are not met)
  • Clearing Fee is per store and per invoice for the first 20 items them 10% of initial fee per item. 
  • Storage fees: Packages received at Lots warehouse without a delivery booking will be billed P50 storage fee per day. Gaborone-Pickup-orders must be collected within 3 days. P50/day storage fee will be charged thereafter.


4. Returns & Liability



  • Customers must log a return request directly with their supplier before requesting Lots to return an item.
  • Returns are collected only from Gaborone addresses; customers outside Gaborone must transport the item to Lots’ address at their own cost.


Lots is not responsible for:

  • Wrong items, missing parts, or damages caused by supplier.
  • The accuracy of items received from supplier, as we do not inspect packages.


5. Delivery & Risk



  • Estimated delivery times are provided as a guideline and may be subject to customs delays.
  • Once an item is delivered to the customer's specified address, Lots is no longer responsible for any loss, theft, or damage.


6. Prohibited & Restricted Items



Customers must comply with Botswana import regulations. We do not transport:

  • Prohibited or restricted goods (e.g., firearms, perishable items, hazardous materials).
  • Any item banned by Botswana Revenue Services (BURS) or South African Customs.


7. Limitation of Liability

Lots shall not be liable for:

  • Delays due to customs clearance or unforeseen circumstances.
  • Loss, damage, or misdelivery due to incorrect customer information.
  • Any indirect, incidental, or consequential damages arising from service use.


8. Changes to Terms

Lots reserves the right to update these Terms of Service at any time. Continued use of our services after changes are made constitutes acceptance of the updated terms.

Affiliate Program Terms


1. Definitions


For the purposes of this Affiliate Program section:


“Affiliate” means any individual or entity approved by Lots Logistics to promote Lots services and earn commissions on referrals tracked through the Affiliatly platform.


“Affiliatly System” means the third-party affiliate tracking and management service provided by Affiliatly used by Lots Logistics to administer the affiliate program.


“Commission” means the amount payable to an Affiliate in accordance with the rules established by Lots Logistics and tracked through the Affiliatly System.


“Personal Data” means any information relating to an identified or identifiable natural person or juristic person as defined in applicable privacy laws.


2. Participation in the Affiliate Program


Participation in the Lots Logistics Affiliate Program is subject to Lots Logistics’ approval. By joining, the Affiliate agrees to:


Use the Affiliatly System lawfully and in good faith;


Comply with all applicable laws and regulations, including but not limited to anti-spam, marketing, and consumer protection laws; and


Not use any unlawful, deceptive, or abusive methods to refer traffic or customers to Lots Logistics.

Affiliatly may terminate or suspend an Affiliate’s access to the tracking system if these requirements are breached. 



3. Affiliate Obligations and Relationship


Affiliates acknowledge that disputes regarding tracking, payments, commissions, or interactions with referred customers are matters between the Affiliate and Lots Logistics. Affiliatly is only a service provider facilitating tracking and reporting.


Affiliates will not represent themselves as employees, agents, or legal representatives of Lots Logistics. The relationship is strictly that of independent contractors. 



4. Data Protection and Privacy


a. Compliance with Privacy Laws

Lots Logistics and all Affiliates must comply with applicable data protection laws in Botswana when processing personal data, including:


The Botswana Data Protection Act No. 18 of 2024, which governs the collection, processing, transfer, and protection of personal data and requires appropriate safeguards when processing personal information. 


b. Affiliatly Data Handling

The Affiliatly System may process personal data on behalf of Lots Logistics for the purpose of administering the affiliate program. Lot’s affiliates agree that:


Personal data transmitted to or processed by the Affiliatly System will only be used for the stated affiliate tracking and commission purposes;


Where the processing involves personal data of individuals in Botswana or South Africa, such processing will be in accordance with applicable legal requirements, including securing lawful consent where required and ensuring appropriate technical and organizational measures are in place to protect personal data;


Affiliates must obtain all necessary consents from referred individuals for the collection and transmission of personal data to Affiliatly and Lots Logistics. 


5. Transparency and Disclosure


Affiliates must ensure clear and conspicuous disclosure of affiliate relationships when promoting Lots Logistics services in accordance with applicable advertising, consumer protection, and privacy laws. This includes notifying referred individuals that:


The Affiliate may earn a commission for referrals; and


Their personal data may be processed in connection with tracking and fulfilling such referrals. 



6. Termination


Lots Logistics may suspend or terminate an Affiliate’s participation in the program at its discretion, including for non-compliance with these Terms or applicable laws. Upon termination, Affiliates must cease all promotional activities and remove tracking links as directed.


7. Governing Law


This Affiliate Program section and any disputes arising in connection with it are governed by the laws applicable to the Lots Logistics Terms and Conditions. Where privacy or data protection obligations arise under Botswana law, such laws will supplement these Terms to the extent required.
